Public Records

Requests must be for records in the possession of or prepared, owned, used or retained by JAA. Requests must contain identifiable information to sufficiently fulfill the request. The requestor will be notified if the JAA is not in the possession of or prepared, owned, used, retained by JAA and/or otherwise not subject to disclosure. Public records requests will be deemed as insufficient if the records requested are not clearly identifiable. The requester will be contacted for clarification before further processing an insufficient records request.


Confidential information

Requests for documents containing confidential information or that are otherwise exempt from public inspection or copying under the public records law will (1) be redacted accordingly or (2) not provided. Confidential information will be redacted from records prior to inspection, examination and distribution of copies.

Public records request submissions will be reviewed by the JAA for compliance with Florida Statute 119. Response time, production time and a cost estimate (if applicable) will be prepared and provided to the requester as soon as reasonably possible. The requester will be notified of the approximate number of pages and length of time the JAA estimates it will take to process the request. A public records request invoice with estimated costs will be sent to the requester and a good faith deposit must be received by JAA prior to processing the request. Final payment is required before release of records.


Public Records Request Fees

Per F.S. 119, the JAA may apply fees for records requests requiring more than one hour of administrative time as noted below:

• $0.15 per page – single-sided black-and-white copies on letter- or legal-sized paper
 $0.20 per page – double-sided black-and-white copies on letter- or legal-sized paper
 $1 per page – certified copies
 $15 per hour – administrative time over 30 minutes
 Data copied to CD or DVD
- First copy is free
- Additional copies are $2 per CD and $5 per DVD


Extensive Use of Resources Fees

For public records requests that require extensive use of information technology resources, clerical or supervisory assistance, the requestor will be charged a special service fee. The fee is based on the cost incurred for the extensive use of such resources, including labor in furnishing or copying the information requested. The special service fee applies to requests for both inspection and copies of public records. Payment must be received by the JAA prior to the release of records.

Florida law requires agencies to furnish public records in the format requested if they already exist in that format. Therefore, records that exist in paper format will be provided in paper format and records that exist in electronic format will be provided in electronic format. Additionally, Florida law does not require the custodian to create new records in order to accommodate a request for information nor does it require the custodian to give out information from the records of his or her office.



Video Surveillance/recordings

Video surveillance recordings are, in most instances, exempted them from public disclosure.  More specifically, Florida Statutes and caselaw exempt video surveillance and other information relating to security systems as confidential and exempt from public access or disclosure.  Such information reveals the capabilities – and as a corollary, the vulnerabilities – of JAA’s security / surveillance system and, therefore, the plain language of section 119.071(3)(a), Florida Statutes, considers the same confidential and exempt from public inspection.

Video recordings are only available for 30 days after the date and time of recording.
